Emergency Motion For Reconsideration

Room Service Woman, on behalf of Egg #3, aka Little Guy, Bleener, hereinafter “The Chick,” respectfully requests reconsideration of this Court’s decision to remove The Chick from the Nest and simultaneously withdraw all rights and privileges of membership in the Clutch. New evidence has been uncovered to demonstrate that The Expulsion was a miscarriage of justice and therefore  this Court should reexamine its previous Order of Removal.

This Court should readmit The Chick to the Clutch for the following three reasons:

  • First, The Chick could not hatch through no fault of its own; the membrane of the egg dried too quickly due to the warm weather, sticking to its body, and thus emerging from the egg was impossible;
  • Second, Egg #3 has nevertheless completed its transformation to The Chick with the help of damp towels and time in an incubator with the humidity setting on “Washington D.C. summer.”
  • Third, The Chick has demonstrated its potential for corvid toughness by surviving 1) getting dumped; 2) getting kidnapped by an unknown humanoid predator who may or may not have been Room Service Woman in a black raincoat, baseball cap, with a sweater tied around her face; 3) hatching despite all odds; and 4) lasting 24 additional hours on its own.

In spite of the aforementioned heroic efforts, The Chick cannot survive much longer. Efforts to start up The Chick’s digestive system by obtaining saliva from American crows (aka peasant birds) have failed. The Chick is now passing undigested food, indicating that it is not receiving the nutrients it needs.

Therefore, Petitioner urgently requests immediate readmission to the Nest.

ORDER

The Chick is hereby provisionally readmitted to the Nest, effective immediately. The Chick is solely responsible for obtaining sufficient food in competition with its two siblings for survival. No provision will be made for the Chick’s comparatively small size. Brooding will be provided as required.
